CCI’s Findings on Microsoft Practices
The Competition Commission of India (CCI) has conducted a thorough examination of various allegations concerning Microsoft’s business practices, focusing on issues such as unfair conditions, barriers to technical advancement, and market access limitations. After careful consideration, the CCI addressed each concern with a measured approach.
On the matter of unfair conditions, the CCI concluded that there was no substantial evidence to support claims that users were coerced into using Microsoft Defender. The commission noted that users have the freedom to install third-party antivirus software, either through the internet or via the Microsoft Store. The order stated, “Users are free to install any third-party antivirus software of their choice, either through the internet or via the Microsoft Store. They can opt to continue using Microsoft Defender or replace it with a non-Microsoft solution on Windows…Therefore, in the absence of an element of compulsion or imposition, prima facie there appears to be no violation of Section 4(2)(a)(i) of the Act.”
Furthermore, the CCI dismissed allegations regarding impediments to technical development, citing a lack of evidence and the ongoing innovation within the antivirus sector. The commission remarked, “The technological progress in the cybersecurity and OS sectors remains dynamic and is not hindered by alleged Microsoft practices…. thus allegations against Microsoft in respect of any actual or potential impediment to technical and scientific development appear to be largely speculative and lack relevant proof of harm.”
