CCI dismisses complaint against Microsoft

In a recent ruling, the Competition Commission of India (CCI) has dismissed a complaint against Microsoft concerning the bundling of its anti-virus software, Microsoft Defender, with the Windows operating system. The complaint alleged that this practice infringed upon fair competition standards.

The CCI’s decision, articulated in a comprehensive 17-page order dated March 3, indicates that there was no prima facie case of contravention. The regulator undertook a thorough examination of two pertinent markets: the market for computer security (antivirus) software specifically for Windows OS in India and the broader market for desktop and laptop security software within the same ecosystem.

Upon reviewing Microsoft’s arguments, the CCI noted that users are not mandated to utilize Microsoft Defender as their sole antivirus solution. Furthermore, it highlighted that Original Equipment Manufacturers (OEMs) have the flexibility to pre-install alternative third-party antivirus software on devices operating with Windows OS. This flexibility is crucial in maintaining a competitive landscape.

In its order, the CCI also drew comparisons with other operating systems, such as macOS and ChromeOS, which similarly incorporate built-in antivirus functionalities. The absence of compulsion or imposition in Microsoft’s approach led the CCI to conclude that there appears to be no violation of Section 4(2)(a)(i) of the Competition Act, which addresses the abuse of a dominant market position.

The regulator further emphasized that the antivirus solutions market remains vibrant, with numerous established players continuing to thrive despite the presence of Microsoft’s integrated security software. The CCI found no significant barriers to entry or exclusion, reinforcing the notion that competition remains robust in this sector.
